DWI Florida

 

Dwi Florida laws are some of the most severe in the nation.  You need to know what they are and want your rights are.

Florida Dwi Law basically state that if you have a Blood Alcohol Concentration of .08% or greater, than it is illegal for you to operate a motor vehicle.  If you do, you make yourself open for arrest for DWI.

If arrested for a DWI in Florida will trigger two court actions.  The first will be on your personal liberties that can include fines, probation, and possible jail time.  The second court action will be with the Florida Department of Highway Safety and Motor Vehicles to determine driving restrictions.  This second must be submitted to within 10 days to try to keep your license.  Failure to adhere to this timeline will result in a suspension of your license for six to eighteen months.

Dwi Florida – Fines

  • 1st conviction $250 to $500.  If a minor in vehicle or more than .20% BAC  $500 to $1,000 plus community service.
  • 2nd conviction $500 to $1,000.  If a minor in vehicle or more than .20% BAC $1,000 to $2,000 plus community service.
  • 3rd conviction in 10 years up to $5,000.  If a minor in vehicle or more than .20% BAC not less than $2,000 plus community service.
  • 4th conviction or more, not less than $1,000.  If a minor in vehicle or more than .20% BAC not less than $2,000 plus community service.

DWI Florida – Jail Time

  • 1st conviction up to 6 months.  If a minor in vehicle or more than .20% BAC up to 9 months.
  • 2nd  conviction up to 9 months.  If a minor in vehicle or more than .20% BAC up to 12 months.
  • 3rd conviction up to 12 months.  If conviction within 10 years mandatory 30 days jail time.
  • 4th conviction up to 5 years.

The only way to limit these fines and penalties is to have an experienced DWI Lawyer.  If you get arrested, it needs to be the very first thing that you do is find one.  

You will need to have someone with expertise and experience with all of the different requirements and obligations that you will be facing.  It’s crucial that you know what the law states and how it applies to your case.  Going into court alone, without legal representation should never be an option.
